In administering the recruitment and onboarding process, the Administrative Review Tribunal (the Tribunal) adheres to the Privacy Act 1988 (Privacy Act), including the Australian Privacy Principles (APPs). The APPs set out standards, rights and obligations for how we handle and maintain your personal information. This includes how we collect, store, use, disclose and secure personal information, as well as your rights to access or correct your personal information.

What personal information will be collected
The Tribunal will collect personal information from you through the recruitment process, this includes requesting details provided on any forms required for registering an account, applying to one of our registers (temporary employment or s26), selection, placement, and onboarding of successful candidates. This may include:
- Name, physical address, phone number and email address
- Diversity information such as ATSI, disability, LGBTIQA+, CALD and gender (optional questions)
- Employment history and details
- Qualification verification
Only if offered employment:
- ID verification and National Criminal History check
- Date of birth
- TFN
- Bank details
How your personal information will be collected
The Tribunal collects personal information directly from you when you register an account, complete the online application and through the onboarding process. Should you progress through the recruitment process, further personal information may be collected via the following methods:
- Contact with referees about your suitability for the role. This may be undertaken by the Tribunal, an assessment panel member or by an external recruitment service provider engaged to assist with the recruitment process.
The following digital platforms are assisting the tribunal with the collection of your personal information:
- Big Red Sky – Thomson Reuters eRecruitment system (Thomson Reuters privacy policy).
- MS Teams for video conferencing to conduct interviews (Microsoft privacy statement).
- HROnboard to facilitate the onboarding process. HROnboard is owned by ELMO Software Limited (ACN 102 455 087), and adheres to ELMO’s data privacy and protection policy.
- Veritas Check conduct ID verification, citizen and National Criminal History checks (Veritas Check privacy policy).
How your personal information will be used and disclosed
Your personal information will be used for the purpose of filling roles using the Temporary Employment Register (non-ongoing roles), the s26 Transfer Register and considering your application for the role you are applying for to create a merit pool.
As part of the selection process, your information may be provided to:
- Tribunal employees involved in the administration of the recruitment process
- Members of the selection panel responsible for assessing your application and making a recommendation to the delegate
- The delegate (the Tribunal's manager who has overall authority to approve selection decisions)
- External recruitment service providers if they have been engaged to manage or assist with recruitment activities. We use face2face (privacy policy) and Hays (privacy policy).
- Where personal information is to be shared with external parties, the Tribunal will ensure that the correct and current information is provided.
- Relevant persons for APS gazettal requirements
- Your referees
- Veritas Check to obtain ID verification, citizen and National Criminal History checks
- The Australian Government Security Vetting Agency to obtain and maintain security clearances (if required)
- Other APS agencies to facilitate the movement of staff between agencies (if required)
- Any other person with a lawful entitlement to view or be given your information.
The merit pool can be used for future similar vacancies at the Tribunal and with other Commonwealth agencies who elect to use our merit pools unless you select 'opt out' on the application form when applying for a gazetted recruitment process. The personal information you provide may be viewed for that purpose by appropriate delegates or Tribunal employees who have a need to view this information.
If the Tribunal identifies any other reasons to disclose your personal information other than those listed above, we will endeavour to seek your express consent before doing so.
Recruitment services providers that are engaged by the Tribunal are contractually obligated to abide by the Privacy Act and the APPs.
If we don’t collect this information
Some information requested is mandatory and some is optional. If you do not provide the mandatory personal information requested during the registration and application process we may not be able process your application or properly consider it. This may mean that:
- you may be unable to apply for vacancies with us
- we may not be able to consider your application or suitability for a role at the Tribunal
- you may be disadvantaged compared to applicants who have supplied the requested personal information
- we may not be able to contact you to advise of your progress or any update regarding the recruitment process.
Will your personal information be disclosed overseas?
Your personal information is unlikely to be disclosed to overseas parties unless a referee is located overseas. If the Tribunal becomes aware that your personal information will be disclosed overseas, we will do our best to inform you before this occurs. Each overseas party accessing your personal information is required to comply with the Privacy Act.
