Upcoming changes to case pathways

The Administrative Review Tribunal is committed to continuously improving its case management practices. We are making changes that will better support parties to reach agreement in a way that is as fair and efficient as possible.

In the lead up to the establishment of the new Tribunal, stakeholders told us that parties are often unclear about the nature, purpose and duration of Tribunal case events.

In response to this feedback, we are changing our approach for reviews where the decision-maker is a participating party. This includes all NDIS, Taxation and Business, and Veterans’ and Workers’ Compensation related matters. It also includes some reviews in the General, Social Security and Migration areas.

From 1 August 2025 certain reviews will now be listed for a case management directions hearing before a registrar rather than going to a conference. Eligible cases will be those where both parties are represented, or where the case is unlikely to be resolved through dispute resolution alone.  

The changes mean that these types of reviews will have fewer and shorter Tribunal case events. We are also improving how we provide outreach for self-represented parties, and how we communicate with users about what they can expect during a Tribunal case event.  

Parties will receive listing notices that tell them what type of case event they have and to help them prepare. Our website also has information about how to prepare for Tribunal case events
