Systemic issues notices

Under the Administrative Review Tribunal Act 2024, the Tribunal can identify systemic issues in administrative decision-making. Jurisdictional area leaders must inform the President of systemic issues, who may then notify relevant Ministers, Commonwealth entities and the Administrative Review Council.

A systemic issue is a problem in government decision‑making that appears across many Tribunal cases, rather than being limited to a single decision.

The President has issued the following notices:

This notice relates to the automatic offsetting of income tax refunds against alleged family assistance overpayments. 

This notice relates to whether government agencies, particularly the Department of Social Services, should continue to apply their own interpretation of the law when the Tribunal has reached a different interpretation in a review decision.
